Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, mobile app, and coaching services (collectively, the "Service") provided by Milestone Fitness, operated by Nik Ripley in Melbourne, Australia ("we," "us," "our").
By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Eligibility
- You must be at least 18 years old to use the Service.
- You must be capable of safely undertaking moderate to high-intensity physical activity, or have approval from your healthcare provider to do so.
- You must provide accurate, complete information during sign-up and keep it updated.
2. Health and safety disclaimer
Milestone Fitness provides coaching services, not medical advice. The Service is not a substitute for professional medical consultation, diagnosis, or treatment.
Before starting any nutrition or training programme:
- Consult a qualified healthcare professional, especially if you have any medical condition, injury, allergy, pregnancy, or medication regimen
- Be honest about your health status, injuries, and limitations during intake — your plan is built around what you tell us
- Stop training immediately if you experience pain, dizziness, or unusual symptoms — and consult a doctor
You participate at your own risk. By using the Service, you assume all risk for injury, illness, or other harm that may result from physical activity, dietary changes, or following our recommendations.
3. Subscriptions and billing
Milestone Fitness offers three subscription tiers:
- App Member: $10 AUD per week — app-only access
- Milestone Nutrition: $30 AUD per week — hand-built nutrition + check-in coaching
- Nutrition + Training: $50 AUD per week — nutrition + training programme
Billing terms
- Subscriptions auto-renew weekly via Stripe
- Charges are taken every Friday from the payment method on file
- You can cancel anytime — see Section 4
- Prices may change with 30 days' notice. Existing subscribers continue on the prior price for the duration of any pre-paid block.
- Failed payments: we'll attempt to charge for up to 3 days, then suspend the Service until payment is resolved
4. Cancellation and refunds
How to cancel
You can cancel anytime by:
Cancellation takes effect at the end of the current billing week. You retain access to the plan and Service through that week.
Refund policy
- No refunds for partial weeks — you keep access through the paid period
- Pre-paid blocks (e.g., 4-week or 12-week blocks): a pro-rata refund is available if cancelled within the first 7 days, less any plans already delivered
- Refunds are not provided for failure to follow the plan, lack of results, or change of mind after Day 7
- Refunds are issued back to the original payment method within 7 business days
These refund terms operate alongside your rights under the Australian Consumer Law.
5. Intellectual property
All Service content — nutrition plans, training programmes, meal databases, coaching frameworks, branded materials — is the intellectual property of Milestone Fitness.
You may:
- Use plans for your personal training and nutrition
- Share screenshots of progress on social media (tagging us is appreciated, not required)
You may NOT:
- Resell or redistribute our plans, content, or coaching materials
- Modify and republish our content as your own
- Share your Trainerize account login with non-subscribers
6. Account security
You are responsible for keeping your account credentials secure. Notify us immediately if you suspect unauthorised access.
7. Acceptable use
When using the Service, you agree not to:
- Use the Service for any illegal purpose
- Harass, abuse, or threaten your coach or other users
- Attempt to reverse-engineer, scrape, or hack the Service
- Misrepresent your identity or impersonate another person
We reserve the right to suspend or terminate accounts that violate these terms.
8. Service availability
We aim for the Service to be available 99% of the time but cannot guarantee continuous availability. Scheduled maintenance, third-party outages (Trainerize, Stripe, Netlify), and force majeure events may occasionally interrupt the Service.
If you experience downtime affecting your coaching:
- For check-in delivery delays: your plan is delivered as soon as the Service is restored
- For prolonged outages (>72 hours): we'll credit your account for the affected period
9. Limitation of liability
To the maximum extent permitted by Australian law:
- The Service is provided "as is" without warranties beyond what's required by Australian Consumer Law
- We are not liable for indirect, consequential, or punitive damages
- Our maximum liability in any 12-month period is limited to the amount you've paid us in that period
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
10. Privacy
Our handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email to active subscribers at least 14 days before they take effect. Continued use of the Service after that period constitutes acceptance.
12. Dispute resolution
If you have a complaint:
- Contact us first. Email info@milestonefitness.com.au. We will respond within 5 business days.
- If unresolved: escalate to the Victorian Civil and Administrative Tribunal (VCAT) or Consumer Affairs Victoria.
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
